Terms & Conditions


The Modern Voyager


Travel Designer: Tegan Bombard, operating as The Modern Voyager ("Designer", "we", "us", "our")
Client: The person or entity contracting the Designer's services ("you", "your", "Client")


Business Structure

The Modern Voyager is an independent travel advisor affiliated with WorldVia Network. We provide travel design and planning services as an independent contractor. All actual travel services (cruises, hotels, tours, transportation, etc.) are provided by third-party suppliers under their own terms and conditions.


1. Scope of Services

We provide travel designing/planning services including: itinerary design, vendor and supplier booking support, coordination of travel components (cruises, resorts, tours), communication support, consulting, and on-site assistance during retreats or group travel when applicable.

We act as an intermediary between you and third-party suppliers (cruise lines, hotels, tour operators, ground transport, etc.). All actual travel services are provided by those third-party suppliers under their terms.


2. Booking, Payments & Fees

Planning Fees:

Our planning fees are based on trip complexity and are due upon acceptance of your proposal. Planning fees are separate from supplier commissions and cover our professional research, coordination, and booking services. All planning fees are non-refundable once services have commenced.

Standard Planning Fee Schedule:

Simple Bookings

  • Flight only: $75
  • Hotel only (single property): $75
  • Cruise only: $150

Moderate Complexity

  • Flight + Hotel package: $175
  • All-inclusive resort: $175
  • Multi-hotel trip (same destination): $225

Complex Planning

  • Cruise with pre/post accommodations: $275
  • Guided group travel: $350
  • Multiple destinations (2-3 locations): $450

Premium Custom Planning

  • Fully customized multi-destination itinerary: $600
  • International multi-country trips: $900

Additional Fees:

  • Groups of 6+ travelers: Additional $50 per person
  • Rush service (departures within 30 days): 50% surcharge
  • Major itinerary revisions (beyond 2 included rounds): $100 per revision

We reserve the right to adjust fees for repeat clients, referrals, or special circumstances at our discretion.


Supplier Deposits:
Deposits required by third-party suppliers (cruise lines, hotels, tour operators, etc.) are separate from our planning fees. These deposits are determined by the supplier and are subject to their cancellation and refund policies.


Payment Timeline:
Full payment must be received by the date specified in your invoice to secure bookings. Delayed payment may lead to cancellation of reservations or forfeiture of services.

We will disclose all known fees and costs upfront, including our planning fees and estimated supplier costs.


3. Cancellation & Refund Policy

Planning Fees:
Once planning services have commenced, our planning fees are non-refundable.


Supplier Cancellations:
If you cancel after bookings have been made with suppliers, you are responsible for any non-refundable payments made to those suppliers per their terms and conditions. Supplier cancellation and refund policies vary by vendor and package. If suppliers deny refunds, we cannot guarantee full reimbursement to you.


Our Liability:
We are not responsible for fees or penalties imposed by third-party suppliers due to your cancellation.


4. Changes & Modifications

You may request changes to your itinerary or other travel components. We will make reasonable efforts to accommodate changes, but modifications may incur additional planning fees or supplier rate changes.

Changes requested close to departure may have limited options and higher costs. You are responsible for any fees or penalties imposed by suppliers due to requested changes.


5. Client Obligations & Accuracy of Information

You must provide accurate and complete information including names (as they appear on official documents), birthdates, passport/visa details, special requirements, dietary restrictions, accessibility needs, and any other information necessary for booking.

Errors or omissions in the information you provide may cause delays, additional costs, or booking issues, for which you are responsible.

You are responsible for obtaining and maintaining valid travel documents (passports, visas, vaccinations, etc.) and for complying with all health, safety, and legal regulations both in the U.S. and in foreign jurisdictions.


6. Insurance & Risk

Travel Insurance Requirement:

  • For bookings over $5,000, international travel, or cruises: Travel insurance is mandatory. You must provide proof of your own coverage or select a policy from the options we provide.
  • For all other bookings: We strongly recommend travel insurance. If you decline coverage, you must sign a liability waiver acknowledging financial responsibility for trip cancellations, interruptions, medical emergencies, and other covered events.
  • Waiver Deadline: If you decline travel insurance and do not sign the required waiver within 30 days of your deposit, you authorize us to obtain basic travel insurance on your behalf (through a third-party provider) and add the cost to your invoice.


Coverage Recommendations:
Travel insurance should cover trip interruption, cancellations, medical/emergency evacuation, baggage loss, and other travel-related risks.

If you decline insurance and do not sign the required waiver, you accept full financial risk for any losses incurred.


7. Limitation of Liability

Force Majeure:
We are not liable for events beyond our reasonable control, including but not limited to: natural disasters, governmental restrictions, pandemics, severe weather, mechanical failures, strikes, civil unrest, terrorism, or other force majeure events.


Supplier Failures:
We are not responsible for the quality, safety, delays, cancellations, or other failures of third-party suppliers (cruise lines, hotels, tour operators, airlines, etc.). Our liability is limited to what supplier terms and conditions allow.


Liability Cap:
Our liability for any claim arising out of our services is limited to the amount of planning fees paid by you for the specific services which gave rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.


8. Termination of Services

We reserve the right to terminate our engagement if you:

  • Violate these Terms & Conditions
  • Fail to make required payments
  • Behave inappropriately or abusively toward us or our partners

In the event of termination, you remain responsible for all costs incurred up to the date of termination, including non-refundable planning fees and supplier charges.


9. Dispute Resolution & Governing Law

These Terms & Conditions are governed by the laws of the State of Florida.

Any dispute arising from these Terms or our services shall be resolved in Lake County, Florida, or as mutually agreed.

We prefer to resolve disputes through good-faith negotiation or mediation before pursuing legal remedies. If mediation fails, either party may pursue legal action.


10. Privacy & Data Use

We collect and store personal data necessary to provide travel design services, including but not limited to: name, contact information, passport details, health information (if needed for travel), payment information, and travel preferences.


Data Protection:
We will securely store and protect your data. We will share your information with third-party suppliers only as necessary to complete your bookings.


No Sale of Data:
We will not sell your personal data to third parties.


Data Retention:
We retain your data as needed to provide services, comply with legal obligations, and maintain records. You may request deletion of your data by contacting us, subject to legal and contractual retention requirements.


11. Changes to Terms & Conditions

We reserve the right to update or modify these Terms & Conditions at any time. When we do, we will post the revised version on our website or send it to you directly.

Revised Terms become effective immediately upon posting or as otherwise noted. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.


12. Entire Agreement

These Terms & Conditions, together with any proposal, package description, quote, invoice, and other written agreements, form the entire agreement between you and The Modern Voyager.

These Terms supersede any prior understandings or agreements, whether written or oral.


Acknowledgment

By engaging our services, making a deposit, or signing a proposal, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
